Why can I reclaim?
This all stems from the fact that by law credit card companies should only charge a "fair" amount for the charges they make.
The OFT looked into what was fair in 2006. They concluded that it was only fair for the credit card companies to charge what it actually cost them to write to you notifying you of the default.
A fair charge should therefore be pennies. It should certainly be no more than a couple of pounds.
The OFT as an interim measure said that they would not investigate credit card companies who charged £12.00 or less. They did not say that this was a fair charge. It was simply an interim measure that they put in place to deal with the worst abuses of the credit card companies until the credit card companies could present evidence about what the actual cost of sending the letter out was. In the words of the OFT report:
"We have decided that, as a provisional step, it is appropriate to give
priority to addressing default charges which exceed a simple monetary threshold
of £12, in line with our duty to use our resources to tackle contract terms that
have the potential to cause the most serious harm to consumers. We are not
suggesting that default fees should be set at £12, and a court will certainly not
consider that a default fee is fair just because it is below the threshold."

Putting all of this together, if you have received any charges of £30 or £35 you should be able to reclaim the difference between this figure and £12 without difficulties. In many cases, you can claim the full amount of the charges going back 6 years.
